Privacy Policy

This policy explains how Imago collects, uses, stores, and protects personal and engagement data across its learning platform.

1. Overview

This Privacy and User Agreement ("Agreement") explains how Imago (Shoulet Blunt, LLC dba Imago) collects, uses, stores, and protects personal and engagement data on learn.weareimago.com and related mobile applications.

2. User Responsibilities

Users must access and use the Imago Platform in a lawful, ethical, and respectful manner. By using the Platform, users agree to these Acceptable Use terms:

  • Authorized Use Only: Access is limited to registered users with a valid account. Users must not share login credentials or let others access the Platform on their behalf.
  • No Misuse or Disruption: Users may not interfere with the Platform, attempt unauthorized access, deploy harmful code such as viruses or malware, or do anything that degrades performance or security.
  • Respectful Conduct: Users may not use the Platform to upload or share discriminatory, abusive, harassing, defamatory, or otherwise inappropriate content.
  • No Commercial Exploitation: Users may not sell, resell, sublicense, or exploit the Platform for commercial gain unrelated to their authorized use.
  • Compliance with Laws: Users must comply with all applicable local, state, and federal laws, including data privacy, education, and employment regulations. Violations may result in suspension or termination of access to the Platform.

3. Account Creation and Protection

Accounts may be created by users directly or provided by partner organizations. Users are responsible for keeping login credentials confidential and for all activity under their account.

4. Data Collection and Use

Imago collects the following data to personalize learning experiences, provide platform functionality, deliver support, and communicate updates. Location data, when used, is only used to improve the user experience and is not shared externally.

  • User-Provided Information, such as name and email
  • Automatically Collected Information, such as device type, browser, usage patterns, and location if enabled

5. Data Anonymization and Analytics

Imago retains full rights to use anonymized metadata, including but not limited to:

  • Completion data
  • Certifications earned
  • Checkpoint responses
  • Engagement metrics

This metadata is tied only to a unique identifier and does not include personally identifiable information (PII). No PII is shared, sold, or used for external analytics or marketing.

6. Privacy Protections & Compliance

Imago complies with all relevant educational privacy regulations, including:

  • FERPA (Family Educational Rights and Privacy Act)
  • SOPIPA (Student Online Personal Information Protection Act)
  • COPPA (Children's Online Privacy Protection Act), where applicable

Imago follows the NIST Cybersecurity Framework (CSF). User data is encrypted in transit and at rest, and access is limited to authorized personnel. Imago follows best practices for data retention, access logging, and breach monitoring.

7. Data Retention and Deletion

User data is kept while the user account is active and for a reasonable time afterward to support reactivation or institutional reporting. Users may request deletion of their data by contacting support@weareimago.com.

8. Third-Party Access

We do not sell or rent user data. Limited data may be shared only with trusted service providers under strict confidentiality and data processing agreements, or as required by law.

9. Children's Privacy

Imago does not knowingly collect data from users under age 13 without verifiable parental or school consent. COPPA-compliant procedures are followed in all school-partnered deployments.

10. Changes to This Agreement

Imago may update this policy periodically. Users will be notified of significant changes by email or platform notification. Continued use of the Platform indicates acceptance of those changes.

11. Governing Law

This Agreement is governed by the laws of the State of California. Any disputes will be resolved in the courts of Fresno County, CA.
